Gonzales Questions Habeas Corpus

In one of the most chilling
public statements ever made
by a U.S. Attorney General,
Alberto Gonzales questioned whether the U.S.
Constitution grants habeas corpus rights of a fair
trial to every American. Responding to questions from
Sen. Arlen Specter at a Senate Judiciary Committee
hearing on Jan. 18, Gonzales argued that the
Constitution doesn’t explicitly bestow habeas corpus
rights; it merely says when the so-called Great Writ
can be suspended. “There is no expressed grant of habeas
in the Constitution; there’s a prohibition against
taking it away,” Gonzales said."

We made mention of this problem awhile back when we
wrote on the Military commissions and it's direct
contradiction of the US Constitution. Heres what
the constitution says:
Article I, Section 9, of the
Constitution states that “the privilege of the Writ
of Habeas Corpus shall not be suspended_less when in
Cases of Rebellion or
Invasion the public Safety may
require it.”


To insure framers of the constitution meant what they
meant the sixth amendment states:
“In all criminal
prosecutions, the accused shall enjoy the right to a
speedy and public trial, by an impartial jury of the
State and district wherein the crime shall have been
committed … and to be informed of the nature and cause
of the accusation; to be confronted with the witnesses
against him; [and] to have compulsory process for
obtaining witnesses.”

It would now appear that the US Attorney and all the
presidents men in their infinite wisdom have declared
the U.S. Constitution invalid. Many of us have been
asking, let me rephrase that, "begging" people to wake
up. We are not chicken little hollering the sky is
falling. We are sounding the alarm. My fear,
no one is listening.

HEADS UP

Alas it is going to be a hot summer. Legislative sessions around the country are gearing up and MC's are in the cross hairs. While Florida's Gov. Crist takes on the property insurers rep Simmons has introduce HB265 to address Auto insurance rates. By address I mean increase. And I am hearing "significantly". Though the bill does not mention motorcycles it does mention redefining "motor vehicles". Now unless they are talking about snowmobiles my guess is MC's gonna get hit too. But even if they leave MC's out can you afford to take another hit on your cage rights. The upside to date there is no companion bill in the senate. The downside Florida publications wanting to see motorcycles included are hopping on the bandwagon see, the link and post your thoughts. It is never to early to hit back. In Martial arts if someone moves on you , you do not wait to see if they will move again, you use their momentum to strike back fast and hard to insure defeat. Do it now before this gig gets rolling. Unless of course you have no problem with forking over more money to an industry that is going to do nothing but fork you (remember Katrina). I didn't bother writing the rep cause it's already apparent who he's listening to . Crist is new, he has shown some fortitude to date. Hell fill his mailbox up with how you feel about insurance companies attempting to rule the state. Hit the mygov. link in the side bar to get his address.
