Motorcycle Safety?????

Lookee here ok? Fortunately this is not a problem for those of us that live in Florida
But if you live in a state or country that has Helmet laws. Well then you ought to wear one. Other wise you end up being targeted by the police as this couple of Bikers. I can't think of any other reason they could be pulled over unless of course they were speeding. So remember if you are riding in a state that has a helmet law. always wear a helmet. It might just save your "butt" should you happen to have a "crack up"

Setback for Quiq and us????

Am including link (here, search for case # HO29406) where those more knowledgeable than I can try and interpret the courts decision. But it would appear "Quigley" (for more about who and what Quig is all about go to MADD Rays's it's a good read about a true motorcycle "folk Hero" we can all learn from) and all of us have suffered have suffered a major setback.

It would appear that the appelate court has reversed a lower court ruling favorable to "Quig" and us in favor of CHP. THe most disturbing aspect of this ruling to me is the broad powers that the courts grant law enforcement to determine when you are acting in a matter they consider jeopardizing "your safety". In fact I am wondering if the decsion might not even take our choice re: certain activities totally out of our hands.

Of course we must remember this is California. My fear is this could spread like wildfire. My hope is "QUIG" will live long enough and his "B.O.L.T." ("Bikers of Lesser Tolerance" founded by a number of original ABATE members who believed ABATE was becoming to "politically Correct") brothers will continue the fight when he gone. High Court Says Passengers May Question Legality of Traffic Stops

A unanimous Supreme Court ruled yesterday that passengers in vehicles
pulled over by the police have the same rights as drivers to challenge
the legality of the traffic stop when it results in an arrest.

The court said that passengers, like the driver, are "seized" by police
when the vehicle they are traveling in is stopped and are thus covered
by the Fourth Amendment and allowed to challenge unreasonable searches

Now I don't know if any of one else has ever been profiled. I have. Twice in Texas which is notorious for doing so and to such an extent in one area of this (fl) state (which for obvious reasons I won't mention) I actually asked a lawyers opinion. Which was, yepper you are being profiled. But if you try to do anything about it, it will get worse. It may not be as bad now as it was back in the day when tatts and long hair was a guaranteed stop.

It is nice to know that Supreme Court guarantees that you have options. I might also wonder if that ruling may be expanded to "other" witnesses to the "stop".
