It would appear that Leon County, Florida Judge Augustus Aikens decision to throw out alcohol breath test evidence in 4 drunk driving cases is is having far reaching consequences as Defense attorneys across the state are citing his order to help their clients beat the "Rap". See Tallahassee Democrat article here.Leon County prosecutors, of course, are expected to appeal the decisions however the judge has a good point. He finds that that police officers are not being consistent or uniform in the way the apply/conduct a breath test. "IF" that it is true, then obviously it has to be addressed.
My fear however is, like the cell phone issue, how many deaths will not receive justice while this particular issue is being addressed.
As with everything else "government" now days it would appear that the reality is that "nothing" actually gets "fixed" but in fact, becomes more "broken". But thats another rant.
The purpose of this little post is to do a little more of the funky math we do here. I mean like the thought occurred to me when I read this that now, not only do you have cell phone impaired drivers who are 4x's more likely to have an opportunity to take YOUR life, we can add to the mix a possibly increasing number of "Intoxicated" drivers who also have 4x's greater chance at taking "YOU" out.
Now as most people already know and I readily admit, I ain't the sharpest bulb in the drawer. But the way I figure it, in Florida anyway, the most vulnerable vehicle operators on the road (motorcyclists) chance's of dying just went up big time.
But don't freak ok. I mean the last thing we want is for anything we report on this little site to accidentally motivate some "biker" to engage in "biker activism". Just tuck this away in the back of your brain and enjoy the game today (is there a game today?). Ride free and very carefull (is that an oxymoron?)rc
