Constitutional Contempt


Excerpted from commentary by Walter Williams:

Here's the oath of office administered to members of the House and Senate: "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign or domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God." A similar oath is sworn to by the president and federal judges.

In each new Congress since 1995, Rep. John Shadegg, R-Ariz., has introduced the Enumerated Powers Act (HR 1359). The Act, which has yet to be enacted into law, reads: "Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act. The failure to comply with this section shall give rise to a point of order in either House of Congress. The availability of this point of order does not affect any other available relief.

Simply put, if enacted, the Enumerated Powers Act would require Congress to specify the basis of authority in the U.S. Constitution for the enactment of laws and other congressional actions. HR 1359 has 28 co-sponsors in the House of Representatives".

COMMENT: Needles to say this bill has not yet been passed. Why not one may ask? After all the only thing it attempts to accomplish is to keep our elected officials honest and focused on what should be their primary task, protecting and enforcing the "CONSTITUTION OF THE UNITED STATES OF AMERICA". THE BLUE PRINT BY WHICH WE GAINED AND KEEP OUR FREEDOMS.

So why is that this bill can not seem to get passed. Simply put, our elected officials have corrupted the meaning of "serving their constituents". The new definition of serving constituents would appear to be appease the majority at the expense of individual rights in order to get re-elected and maintain "Power."

The problem. We ourselves, the constituents, republican and democrat alike, have become corrupted. By virtue of the fact that we allow the government to daily infringe upon our rights and meekly accede to the restraints of rights that our officials, sworn to uphold, place upon us.

We have allowed partisan ideology to subvert the blueprint for our Freedoms until left with the situation we are faced with today. A government that is now closer to "totalitarian" than "republican". And who is to blame? We are.

Due to laziness, self indulgence, apathy, self indulgence and a plethora of excuses that would make a thesaurus puke we have arrived at a place in time that maybe irreversible. Who, capable of winning, is running for office for the upcoming elections that is capable of turning this situation around????? How many are still in office that by failure to uphold "OUR" constitutional rights have committed TREASON and still remain in office?

And what will YOU do about it???

Similarities between us and Vietnam????

Despite the danger, however, most Vietnamese have resisted pleas to wear
helmets, dubbing them "rice cookers" and complaining that they're too hot,
uncomfortable and even that they block the peripheral vision crucial to
navigating split-second swerves. And many doubt the government will be able to
enforce its new helmet law. "They may put an officer at every intersection,
but for every policeman there are thousands of motorcycles," says Nhung, 20,
Van's friend. "How can police catch them all?"

Her skepticism is well founded. Five years ago, the government passed a
similar helmet law but backed down in the face of popular opposition. In fact,
for an authoritarian regime, Vietnam's government has an awful lot of trouble
enforcing its most basic traffic laws — motorcyclists regularly ignore red
lights and pull into traffic without so much as a glance around. Not only do
teenagers talk on mobile phones while driving, they can increasingly be seen
sending text messages, eyes darting back and forth between the road ahead and

Motorcycle recalls- Honda, Kawasaki, Yamaha

two off-road motorcycles are on the recall list.

The first is Honda's XR-50 motorcycle. The company is recalling 22,000 of the off-road bikes.

Honda has received four reports of handlebars separating from the motorcycles, but no injuries have been reported. It's also received four reports of loose handlebars caused by one of the two bolts failing.

The recall includes only years 2000 and 2001 off-road motorcycles with model number XR50R. They are red, and "50R" is written on the sides of the seat on 2000 models, and on the sides of the tank shroud on the 2001 models. The vehicle identification number (VIN) of the motorcycles, listed below, can be found on the left side of the steering head frame tube.

* 2000 XR50R motorcycles have VIN ranges from JH2AE03**YK000013 to JH2AE03**YK0016046
* 2001 XR50R motorcycles have VIN ranges from JH2AE03**1K010001 to JH2AE03**1K0110056

Honda motorcycle dealers nationwide sold the motorcycles from September 1999 through October 2000 for about $1,300.

Kawasaki Motorcycle:
And Kawasaki is recalling 4,000 motorcross competition motorcycles because a frame down tube on the motorcycles can crack below the steering head.

Use of the motorcycle with a cracked down tube can result in failure of the frame, which can cause the rider to lose control of the motorcycle and crash, resulting in injury or death.

Kawasaki has received 60 reports of frames on the motorcycles cracking. Three of the incidents reportedly resulted in the down tube failing, leading to crashes. Injuries to riders included broken bones and abrasions.

These KX65 model year 2000 motorcycles have a vehicle identification number located on their frames behind the front fork. Recalled motorcycles carry VIN numbers with the last four digits between 0001 and 6668. The motorcycles are small, two-wheel, off-road motocross competition vehicles designed for rough terrain. The fenders and bodywork are lime green with large "Kawasaki" decals on each side.

Kawasaki dealers nationwide sold the motorcycles from November 1999 through October 2000 for about $2,700.

Burdge Law Office is investigating a potential class action against Yamaha on behalf of motorcycle owners, involving a deadly transmission defect.

Filings by Yamaha with the Federal government’s Safety Recall "department" indicate that between 29,000 and 53,000 Yamaha motorcycles manufactured with defective transmission parts that can cause the transmission and rear wheel to lock up while in motion, which can throw the driver out of control, possibly causing severe injury or even death.

Yamaha has reported to the Federal government that only about 6,000 or so of these motorcycles were repaired.

Repairs are apparently still taking place but many owners have yet to find out if the "repair" will really take care of the problem. Many other owners now question (with good reason) what their motorcycle will be worth when they try to resell it.

Other defects may also exist in these and other model motorcycles.

Florida Highway Patrol

TALLAHASSEE, Fla. (WOFL FOX 35) -- Twenty-seven people were killed in crashes investigated by Florida Highway Patrol troopers over the five-day Thanksgiving holiday driving period, which began on Wednesday, November 21, and extended through Sunday, November 25, 2007.

During this period, troopers arrested 162 people for driving under the influence of alcohol or drugs. Over seven thousand speeding citations were issued and some four thousand received assistance from troopers.

The following statistics are preliminary and cover only those crashes investigated by the Florida Highway Patrol.

FHP says that over 80 percent of those killed in vehicles normally equipped with safety belts were not wearing their belts.Add to Technorati Favorites
