Citizens have the most to lose when a criminal court judge moves to outlaw the printing, airing or Internet posting of all evidence emerging from a juicy trial.

That's why we media messengers were relieved to hear that B.C. Supreme Court Justice Anne MacKenzie has finally rescinded most of the gag order she imposed eight months ago on an ongoing hearing involving some of the muscle behind the mighty Hells Angels.

I say "most" because MacKenzie has said key evidence linked to a Criminal Code provision dealing with whether the H.A. thugs -- on trial for coke trafficking and related offences -- were members of a criminal organization is still taboo.

What I can say is it concerns a gritty section of the code that has the potential to bring biker gangsters to their knees, in that it metes out a double sentence to those convicted of doing crimes for the benefit of, at the direction of, or in association with a lawless gang.

The clause is a formidable weapon for law-enforcers striving to topple some of the 950 organized crime groups said to be operating in Canada, a hike of nearly 20 per cent over 2006. At least 124 of these gangs are alive and well in B.C (go here for the rest of the story)

Hells Angels win four-year legal fight to regain clubhouse

The Hells Angels have got their clubhouse back.

The motorcycle club wrestled it back from the government after more than four years of legal battles Monday when a federal jury in Minneapolis decided that the building was not used "substantially" to promote the use and distribution of drugs.

"It's a very sweet victory," said Deborah Kay Ellis, the attorney representing the club.

Officially, the building at 3234 Washington Av. N. in Minneapolis belonged to the Minnesota Church of Angels. Government prosecutors started forfeiture proceedings in late 2003, when some Hells Angels members were being prosecuted on drug and money-laundering charges.

So why should this "stuff matter" to you? Because currently in the Florida Legislature there are 4 anti gang bills. Not counting the RICO act that has a history of abuses. But here is the gig,

You know we don't, and we shouldn't, give a whole lot of scrutiny to those we ride with. Fortunately for me. And you know there are times when we may be ridin with some nefarious folk. Now I myself kinda like "nefarious" however not all the police's do. And I know that it may be hard to believe but some (polices or nefariouses) have absolutely no sense of humor at all.

So say you and a few brothers and sister from your local motorcycle riding club is out on a nice Sunday ride. It gets hot and you all stop in a nice little ma and pa tavern to have a brew. Now unbeknownst to you , you gots a "nefarious riding with you.

Now "nefarious" slams a few to many and takes offense at the way the dude next to him looks and commences to wailing on him (or her). Or hell, maybe he or she just steals a candy bar.

Guess what? You have technically become a gang. No way you say. Way I say. If I'm wrong I'll eat that damn candy bar I stolt.Add to Technorati Favorites

When will Florida legislatures focus on the killing fields and not the "wheelie" Fields

Our curses and condemnation to the Florida politicians who would seize a motorcycle for a "wheelie" and let a killer off with a slap on the wrist.

FL: Policeman's son killed in crash
Tampa Bay's 10, FL - Tampa, Florida – The teenaged son of a Tampa Police Officer was killed today when his motorcycle collided with a Lincoln Town Car making a u-turn on Fletcher Avenue near Lake Magdalene.


The Hillsborough County Sheriff's Office said Christopher Sacca, 18, the son of TPD traffic officer Terry Sacca, was pronounced dead at the scene.
Investigators say he was traveling east on Fletcher when the Lincoln, heading west, made a u-turn. The motorcycle struck the right rear quarter panel of the Lincoln.
The driver of the Lincoln was identified as Joseph Mentkow, 81, of Sun City Center. Neither he nor his passenger, his wife, was injured.
The cause of the crash, which closed the intersection for several hours, is under investigation.

FL: Clermont man killed in a two-vehicle crash
Orlando Sentinel, FL - A Clermont man was killed in a two-vehicle crash Tuesday on Turkey Lake Road in Orlando, police reported Wednesday.


Adam Kyle Nagle, 20, was riding a 1996 Suzuki motorcycle south on Turkey Lake Road when a northbound driver attempting to turn left on Wallace Road drove into his path, an Orlando police report said.


Swaleha Farrukh Mughal, 34, apparently did not see southbound Nagle, the report said. The front of the motorcycle struck the right side of Mughal's Ford Windstar van.
Nagle was thrown off his motorcycle and later died at Orlando Regional Medical Center.

Supreme Court may have to decide meaning of the second amendment


Yeah ok I'm stupid. I thought everybody already knew what the second amendment meant:

Amendment 2 - Right to Bear Arms. Ratified 12/15/1791.
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Somebody correct me because we all know I ain't to good in the grammar department but does not that say, "the right of the people to keep and bear Arms, shall not be infringed."

It would appear that the word "militia" is causing folk some problems. I don't see the problem. It does not say that should the state decide it doesn't need a "militia" then the peoples "right" can be infringed upon. It doesn't say that if you want to own "Arms" you have to join a Militia.

So why is this an issue? Because apparently a whole heap of people can not decide how to interpret one sentence. We need nine "SUPREME" folk to argue about "what does it mean?"

Oh well, heres the story from the Tallahassee Democrat: The U.S. Supreme Court last considered a Second Amendment case 68 years ago, but that hiatus is over. Before the court is a hotly contested case that could turn the gun debate on its ear, influence the presidential election, and surely impact our area.

At issue is a Washington, D.C., regulation that bans the possession of all functional firearms. The man challenging the ban is a 65-year-old security guard who lives in a high-crime neighborhood and wants to keep a pistol in his house for protection.

The federal courts that have examined the D.C. gun ban have produced fractured opinions on whether it violates the Second Amendment. Now, the Supreme Court may finally have to decide the meaning of the Second Amendment's declaration that: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed............................................"
