A Declaration of War on the Florida Legislature

and those that would violate my "RIGHT" of way!

Our last four posts have been leading to this one. We ended the post before last

WE ARE IN A WAR and the Florida legislators are our enemies

with the following:

During the 19 years of the Vietnam war 58,209 soldiers were killed (does not include MIA)

303, 635 were wounded in action

Using 2006 figures from the Florida dept of Highway Safety as a baseline in 19 years you would arrive at a figure of 63, 935 traffic fatalities and 4,083,366 injured or "wounded in action". (Note: these numbers are arrived at using 2006 figures and are only an approximation for comparison)

In other words WE ARE TRULY IN A WAR and the Florida legislators are our enemy! The difference is in wars you die for a cause, in Florida you die to enrich the legislators.
We would add to our declaration a clarification of the word "enemy" as it encompasses more than the Florida legislature. It includes those who out of belligerence and disrespect by virtue of the size of their weapons of death no longer feel they have anything to fear from the "Biker" or "Freeman/woman".  Who were not behind the wheel of a vehicle 30 years ago using the excuse, "I didn't see them". Because they all saw us, and did their best to stay as far away from us as possible. They did so because they knew there were consequences for violating the rights that we to paid for. 

Some were even introduced to rusty nuts and bolts that came from nowhere to shatter a windshield, or chain belts and whips that could take out a mirror in a heart beat. Some might say that we have outgrown or out-evolved these tactics as we have learned to form organizations with paid staff who have attempted to brainwash us into believing that we can can win our rights in legislatures or the
courts by trying to convince them we are "citizens" just like they, the politicians or non riding public, are.

To that I say "BULLSHIT", I am not like they are. Never have been and never will be.  I am still an American that believes it when the Declarataion of Independence says:

When in the Course of human events it becomes necessary for one people to dissolve the political bands which have connected them with another and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

and this we will do!

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.

The Florida legislature has moved beyond apathy and negligence to intentional action to risk our lives, safety and happiness through actions that have no other purpose than to fatten their own wallets. We have laid out the numerous violations of human rights engaged in by our legislatures in the pages of this site. You should not have to search for them. Look no further than the capital where the robber barons convene at our own expense.

Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn that mankind are more disposed to suffer, while evils are sufferable than to right themselves by abolishing the forms to which they are accustomed.

It is not a light or transient cause to declare war on a body that jeopardizes the safety, health, prosperity and the lives of those whom it proclaims to govern. I choose to suffer the aristocracy no longer and will exercise my God given right to abolish that which seeks to oppress me.

But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.
I will no longer shirk the duty passed on to me and all of us by those that established this country so that we might all be free.

 Such has been the patient sufferance of these Colonies (individuals); and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present King of Great Britain (Legislators) is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over these States (individuals). To prove this, let Facts be submitted to a candid world.

He (they) has (have) refused his Assent to Laws, the most wholesome and necessary for the public good.

We have noted them in previous posts. Guilty!

He (They) has (have)  forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.

He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of Representation in the Legislature, a right inestimable to them and formidable to tyrants only.

The state no longer holds it's municipalities accountable to state law, allowing them to enact ordinances that contradict state law for the sole purpose of taxation without representation.  No citizen can any longer freely travel the state without fear of violating an ordinance/law enacted by a fiefdom that operates from the knowledge that most can not afford to fight the fines that are levied upon them.

He (They) has (Have) called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their Public Records, for the sole purpose of fatiguing them into compliance with his measures.

Laws are made in haste with little public notice as to when they will be heard at a large distance from the majority of the populace at times that insure that those who will be most affected will be unable to attend to the defense of their rights.

He (they) has (have) dissolved Representative Houses repeatedly, for opposing with manly firmness his invasions on the rights of the people.

During committee meetings at which the people are given opportunity to address their grievances, they leave the room, attend to other matters, and rush to an end meetings designed to provide for a though examination of the legislation before them whom most have not read.

He  (They) has (have) refused for a long time, after such dissolutions, to cause others to be elected, whereby the Legislative Powers, incapable of Annihilation, have returned to the People at large for their exercise; the State remaining in the mean time exposed to all the dangers of invasion from without, and convulsions within.

Which they themselves have caused through their attention to special interest groups and the establishment of laws of such numbers that they themselves can not help but duplicate them. In short they have angered the people through the convulsions they themselves have caused.


He has endeavoured to prevent the population of these States; for that purpose obstructing the Laws for Naturalization of Foreigners; refusing to pass others to encourage their migrations hither, and raising the conditions of new Appropriations of Lands.

He has obstructed the Administration of Justice by refusing his Assent to Laws for establishing Judiciary Powers.

He has made Judges dependent on his Will alone for the tenure of their offices, and the amount and payment of their salaries.

He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our people and eat out their substance.

As evidenced by the unconstrained and out  of control municipalities under his jurisdiction that enact law that violates law and enters into contracts with individuals not sworn to uphold the law to enforce the law.

He has kept among us, in times of peace, Standing Armies without the Consent of our legislatures.

He has affected to render the Military independent of and superior to the Civil Power.

He has combined with others to subject us to a jurisdiction foreign to our constitution, and unacknowledged by our laws; giving his Assent to their Acts of pretended Legislation:

He/They have abandoned the constitution either by will or ignorance in favor of control disguised as governance

For quartering large bodies of armed troops among us:
Our Prison staffs, police forces and their weaponry grow unabated 

For protecting them, by a mock Trial from punishment for any Murders which they should commit on the Inhabitants of these States:

For cutting off our Trade with all parts of the world:

For imposing Taxes on us without our Consent:

Taxing us to fund projects of dubious and suspicious nature as the state continues to lay claim to some of the worst health care, education, and wages encouraging instead "occupations of service"

For depriving us in many cases, of the benefit of Trial by Jury: 

Through threats of harsher sentencing should you be found guilty of asking for your due right

For transporting us beyond Seas to be tried for pretended offences:

For abolishing the free System of English Laws in a neighbouring Province, establishing therein an
Arbitrary government, and enlarging its Boundaries so as to render it at once an example and fit instrument for introducing the same absolute rule into these Coloniea

For taking away our Charters, abolishing our most valuable Laws and altering fundamentally the Forms of our Governments:

Replacing judicial due process with administrative code

For suspending our own Legislatures, and declaring themselves invested with power to legislate for us in all cases whatsoever.

Funded and directed by corporate lobbyists whose only concern is how to profit  from our distress and ignorance.

He has abdicated Government here, by declaring us out of his Protection and waging War against us.

He has plundered our seas, ravaged our coasts, burnt our towns, and destroyed the lives of our people.

He is at this time transporting large Armies of foreign Mercenaries to compleat the works of death, desolation, and tyranny, already begun with circumstances of Cruelty & Perfidy scarcely paralleled in the most barbarous ages, and totally unworthy the Head of a civilized nation.

He has constrained our fellow Citizens taken Captive on the high Seas to bear Arms against their Country, to become the executioners of their friends and Brethren, or to fall themselves by their Hands.

He has excited domestic insurrections amongst us, and has endeavoured to bring on the inhabitants of our frontiers, the merciless Indian Savages whose known rule of warfare, is an undistinguished destruction of all ages, sexes and conditions.

In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince, whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.
We have petitioned only for the rights granted us by the constitution of these United States. We have succumbed to political correctness and "government speak" in an effort to make our voices heard only to be ignored for lack of the price of legislation.

Nor have We been wanting in attentions to our British brethren. We have warned them from time to time of attempts by their legislature to extend an unwarrantable jurisdiction over us. We have reminded them of the circumstances of our emigration and settlement here. We have appealed to their native justice and magnanimity, and we have conjured them by the ties of our common kindred to disavow these usurpations, which would inevitably interrupt our connections and correspondence. They too have been deaf to the voice of justice and of consanguinity. We must, therefore, acquiesce in the necessity, which denounces our Separation, and hold them, as we hold the rest of mankind, Enemies in War, in Peace Friends.

We have tried to elicit our brethren in our quest for truth and justice who have been unwittingly led down the path of the two minute sound bite and struck apathetic by the illusion of powerlessness they have adopted so as not to offend those who oin power would take what they have left.

And here we shall amend the last paragraph, not to make it better. For it can be made no better. It is divine in nature. But to make it more personal as it is not the British who are my enemy.
 
Therefore, as a free citizen and therefor representative of the United States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the signers of this original document by which we declared our freedom, solemnly publish and declare, That as a free born citizen are, and of Right  Free and Independent, that as a follower of the wisdom and bravery of those who created this original document are Absolved from all Allegiance to the legislatures, state or otherwise that no longer hold true to our destiny, and that all political connection between them that would oppress, ignore, seek to illegally profit from and turn a deaf ear not only to those such as myself, but to history as well declare the legislature of the state of Florida to be corrupt and incompetent and as such, is and ought to be totally dissolved; and that as Free and Independent individuals,  have full Power to levy War, conclude Peace, contract Alliances, establish Commerce, and to do all other Acts and Things which Independent persons may of right do. — And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our Lives, our Fortunes, and our sacred Honor.


We further pledge to stand for those unable to stand for themselves and stand against any and all that would steal, bargain, negotiate away, compromise or in anyway interfere the rights granted us by the father and our fathers.

It is reported that the van driver leaned over to pick up a clipboard that fell of his dash.

Note the ranking of Insurance contributions to the candidates who claimed this session (and some in past sessions) to be our, motorcyclists, "Friends." Excluding "loopy" Lopez of course who we only include for his extraordinary ability to scam the ABATE of Florida president/lobbyist, in our opinion (we adds that to keep from getting sued), last session and lack of cajones to admit he was wrong!

Based on our post here: Are Florida legislators guilty of willful and wanton negligence resulting in death?

These figures can not be considered accurate as they do not include the illegal money our legislators have manufactured means to obtain.


Now why is it that 3 of the major players in involved in Sponsoring bills that have the potential to cut down on crashes that result in serious injury or death can not get the job done?  After all, would you not think that that getting such laws passed would be pleasing to their major contributors, i.e. the insurance companies?

Why is it that we can not get any laws passed to address, not just those who negligently seriously injure or kill others through row violations but also distracted driving, or cell phone use. Activities that have been proven to add to the carnage on the killing fields we refer to as Florida's highways?

Could it be that the insurance companies actually make money off of crashes? Consider the following from:  Florida Public Health Review, 2008; 5: 1-7   written by Barbara Langland-Orban, Ph.D., MSPH. Etienne E. Pracht, Ph.D. and John T. Large, PhD. Entitled:

However, comprehensive studies conclude cameras actually increase crashes and injuries, providing a safety argument not to install them. Presently, Florida statutes do not permit red light camera evidence to be used as the sole basis for ticketing drivers for violating the law. Legislation to permit camera citations has been proposed since the 1990s, but none has passed to date. This paper explains red light running trends in Florida; effective solutions to reduce red light running; findings from major camera evaluations; examples of flawed evaluations; the automobile insurance financial interest in cameras; and the increased likelihood of even higher crash and injury rates if cameras are used in Florida due to the high percent of elderly drivers and passengers. The Florida legislature is aware of this information. If not, then they have been negligent in their duties as legislators and should be held accountable for every death that occurs as a result of "red light camera's."  So what action is the Florida legislature taking?

TALLAHASSEE - State legislators are swiftly moving to curb red-light runners via surveillance cameras, while simultaneously gaining a healthy revenue stream to local and state coffers.
Maximum fines for running red lights would be set at $150 -- with the state taking a $30 cut and the rest going to local governments who, thus far, have been able to keep the entire fine.
Operative words:
"while simultaneously gaining a healthy revenue stream to local and state coffers."

This despite the following:

But then go back to our financial contribution charts for our friendly "Biker/Safety advocates" and see where "lawyers" fall on the list of givers because this legislation is going to be a boon to them.

Now motorcycles will be at high risk in the resultant crashes. And who voted "Yea" on the passage of this law? You got it, Representative Evers
Senator Garcia is listed as voting Nay, and Villalobos is listed as not voting period in a number of places. But then if you do not show up you can't vote, i.e. take a stand, make a commitment, follow through on your word, etc. But then he is an attorney. Scroll up and see who contributed most to him?

And as if our elected representatives have not done enough to insure that all our lives will be in even more jeopardy add to the evidence:


Florida Bills Limiting Cell Phone Use By Drivers Hit Dead End

Several bills that would have restricted drivers who talk or text message on their cell phones appear to be headed toward a dead end in the Florida Legislature.
The bills would have banned drivers from sending text messages and required them to use a hands free device while talking on their cell phone. There were also bills that would have made it illegal to use a cell phone in a school zone or for drivers under age 18 to use them.
None of the bills is expected to pass as the Legislature is focused on the budget with Friday's deadline to end the session.
Proponents pointed to several fatal accidents linked to cell phone usage in an attempt to push the bills. Six states ban the use of hand-held cell phones behind the wheel. Text messaging while driving is banned in 10 states.

We ourselves among others have e-mailed and hand delivered to each and every representative and Senator the evidence that use of wireless communications devices while driving is at least equal to "DUI". Obviously with little to no impact.

Word from the Florida legislature on the Stiffer penalties Bill for those who injure or kill motorcyclist

Spoke with Florida Senator Garcia's office this date approximately 5 mins ago and was informed that SB968 and HB1161 are dead. These were the bills that were to add stiffer penalties to those who "negligently" injure or kill a motorcyclists. Despite our last minute plea that they expand the bill to include pedestrians and all motorists. Despite the fact that all the teeth were pulled from the bills and all that was left as an added sanction was community service.

During hearings on this bill approx 7 of us attended committee meetings and spoke out against the watering down of this bill and if it were to be watered down it needed to be killed.

At both meetings we attended the the $50,000.00 plus ABATE of Florida lobbyist supported the watered down version.

During one meeting Tina Mcleeny and I met with Senator Villalobos who promised to rewrite the bill to reinsert the teeth into it that were removed. Although we could not get an agreement on jail time we were able to get and agreement on stiffer fines and revocations of drivers license. Villalobos was to contact Tina and I and have his version ready prior to the next comm. meeting. Contingent of course on the Bill Sponsor, Senator Garcia, whom supposedly submitted the bill for the ABATE Lobbyist, James D. Reichenbach.

Senator Villalobos never contacted this writer and Ms. Mclenny reports he did not contact her. She reports that she contacted his office and was told there was not enough time.  In fact Villalobos never even showed at the next committee meeting where the bill was to be heard. Some refer to such actions as excuses and broken promises. We prefer to refer to them as lies.

Our question becomes, for how many years has the ABATE of Florida lobbyists used the same Senator and Representative to get his stiffer penalties bills introduced, for how many years has the outcome been the same and why is it that ABATE continues to pay an individual to pursue the failed policies of the past that continue to fail?  How will the ABATE president/lobbyist spin this one? Will he again blame the failure on the unpaid "internet cowboys" who suited up and showed to support the bill he claims to have written (which is a claim he may wish to withdraw since a source in one of the offices reported that the bill was poorly written in such a manner that  it could never pass)?

The other question that begs to be answered is just how friendly are Senator's Garcia and Representative Evers to the motorcycling community. Representative Evers is rumored to be a "power broker" in the legislature.  It is also rumored (actually reported by another lobbyist) that he played a major role in seeing that the stiffer penalties were stripped out of 1992 last session.  So , who is fooling/screwing who?

Hats of to WFLA's Eric Eggers for telling it like it is

I should have got to this before now. But now is as good a time as any to give a shout out to Mr. Eggers of WFLA's morning show with Preston Scott.

While talking about extended legislative sessions and proposed and passed legislation Eric made the statement, referring to the legislators, "basically I think they are all full of crap".  And referenced the only way legislation can get passed in Florida is if you have the money to buy it.

Now this ain't nothing we haven't been shouting for God knows how long, but we do not have the reach
the morning show has. And to be quite honest, we were surprised at the cajones exhibited by Mr. Eggers for making those comments on the air.  For that we salute him.

wall that heals run to Appalachicola

Approximately 25 of us met at CCHD to make the trip to Marianna and join up with other bikers to escort the "wall that Heals" to Apalachicola.  There we joined approx. 400 other Bikers and and a wide
assortment of LEO to escort us as we escorted the wall to it's resting place at the "Veterans Memorial Park" in Apalachicola where it will be on display for the week.

Words can not describe the awe that was felt as from city to city, county to county, leo handed us off to the next jurisdiction.

Even more inspirational was, as we rolled into and through the towns of Altha, Wewahitchca, Port St. Joe and finally into Apalachicola, was the crowds of people who lined the streets to wave flags, cheer and hold there hands over their hearts. Students let out of school to witness the procession, to young to remember the war, holding their hands out for the opportunity to give a high five to a biker riding by.
Crowds so thick in some places the procession had to slow down and single file through to get through.

Anybody who has riding those back roads know there is a lot of nothing in between. Yet even in the middle of nothing where there was no need, vehicles stopped and stood with hand over heart as the procession rolled by.

If there was anybody who rode in that procession that did not have a tear in their eye elicited by the outpouring of patriotism, gratitude and respect long over due for those who fought an unpopular war, I don't know who there were.

I do know a few who shed tears on the return home as we thought about this experience compared to the experience s we encounter in Tallahassee and Leon County. Where Springtime Tallahassee get front row billing on Main street and the Veterans day parade gets shuffled to the back roads.
