You can't trust Florida with TRUST fund, now they are stealing firearms money

In a last minute sneak attack on gun owners, the Florida Legislature raided the concealed weapons and firearms licensing trust fund.
This not only effects resident CCW license holders, but non-resident Florida license holders as well!

They took $6 million from the Division of Licensing Concealed Weapons and Firearm Trust Fund that is intended, by law, to be used solely for administering the concealed weapons and firearms licensing program. (Read background information below)

Please Call, Fax, or Email Governor Charlie Crist IMMEDIATELY, and ask him to veto the $6 Million trust fund sweep from the Department of Agriculture & Consumer Services Division of Licensing authorized under Section 59 of the Conference Report of SB-2600.

BACKGROUND:

Right now, the concealed weapons and firearms licensing program is backlogged and overloaded, due in part, to the refusal of budget officials and the Legislature to allow the Division of Licensing to use its own trust fund money to hire more employees and expand/upgrade equipment.

Crates of unopened mail containing license and license renewal applications sit in storage. The backlog of mail sitting unopened, at times, has extended beyond 90 days while existing licenses are expiring because renewal applications haven't been opened and processed.

Currently (although the Division of Licensing has been working weekend shifts to clear the backlog), it is taking 13-14 weeks to process a "perfect" application once it has been opened. That is an unequivocal violation of the law that requires issuance or denial of a license by a specific time –– a violation of law that legislative leaders are condoning by their actions.

THE LAW REQUIRES THE DIVISION OF LICENSING TO ISSUE A LICENSE WITHIN 90 DAYS OF RECEIPT OF THE APPLICATION -- or deny the license "for cause", based upon the criteria set forth in the law. Theft of operating funds by the Legislature is not "just cause" for failure to issue licenses or renewals within 90 days.

While applications sit gathering dust, legislative leaders took $6 million of approximately $8 million held in the trust fund. That $6 million is supposed to be used to pay employees, buy upgraded equipment, upgrade or replace computers or software and to otherwise administer the concealed weapons and firearms licensing program.

BUT, feigning a desperate need for funds for education and health care, legislative leaders recklessly and ruthlessly confiscated trust fund money. Why? Because they were building a so-called "working capital" fund for the 2010-12 legislative term, reported now to be in the neighborhood of $1.8 BILLION DOLLARS. This so-called "working capital fund" is for the use of future legislative leaders.

They didn't take that money for education. They didn't take that money for health care. They didn't take that money to save jobs. They didn't take that money to avoid pay cuts, or budget cuts -- they took the money to help build their own fund.

While Senate leadership reportedly fought to stop the ruthless raids on trust funds, in the end, they simply caved and let the House of Representatives prevail.


The bad behavior doesn't end there.

Obviously fearing the Governor would use his line-item veto to stop trust fund raids, proviso language was inserted in the bill in a clear attempt to intimidate the Governor.

The proviso language, states that if any portion of the moneys swept from this and other trust funds does not become law (meaning it is vetoed), that portion of the money shall be deducted from the EDUCATION BUDGET. This is clearly designed to keep the Governor from vetoing trust fund sweeps, and prevent trust fund money from being taken back out the House leadership's so-called "working capital" fund.

Money in the concealed weapons trust fund came from gun owners. No money to administer and run the concealed weapons and firearms licensing program has ever come from general revenue, or any other state fund or revenue source. The taking of these gun owner user fees is an unauthorized tax on the exercise of the Second Amendment.

AGAIN, Please call, fax and email Governor Crist IMMEDIATELY, and ask him to veto the $6 Million raid on the Concealed Weapons & Firearms Trust Fund!

Letter from the ABATE FLorida lobbyist/President as we predicted and our response

One thing about the Lobbyist/president/office manager of ABATE of Florida, James D. Reichenbach, he is predictable. As we predicted in a previous posts  he has commenced to blaming his failures on others and taking credit for what???????  We have openly challenged the The ABATE of Florida President to send us a list of his accomplishments since obtaining his positions. We expand that challenge to any ABATE member. Send us a list of James d. Reichenbachs accomplishments as a lobbyist in the area of bikers rights and we will print them.  Please, provide documentation and references as opposed to , "Doc said"

THE LETTER FROM THE ABATE PRESIDENT POSTED HERE

Since the last Masterlink Abate has been very busy. We’ve had Bike Week, April State Meeting and the run to the Capitol. I want to thank everyone who participated in these events. I know it takes time out of your lives to support your rights but it’s worth it. If you have been reading or listening to the news lately you know that now not only Bikers but our Veterans are under fire. It is a sad case when the government you have fought and shed blood for decides you are a right wing extremist because you don’t agree with their policies.

 NOTE: Although we have a history of advocating for veterans we are not sure what the ABATE President is referring to as he does not specify in his "letter".  Maybe he is referring to our website, we have have found little on his to point to what he is referring to.



The run to the Capitol was an absolute success despite being on Easter weekend. Our members saw legislators and their aides in a show of support that will go a long way in getting some new laws passed and old ones either removed or revamped.

NOTE: 225 motorcycles, many of whom were not ABATE, out of a claimed membership of 7000+/-
(we have to keep adding that plus or minus because we have yet to be able to determine if they are still counting some members twice, and/or dead members, and/or Life members who no longer associate themselves with ABATE of Florida) showing up to talk to legislators who were not there because of the Easter weekend is a poor demonstration of success. Such words are spin used to lift the spirits of members as any objective, rational person witnessing the debacle would could only call it a dismal failure.   Evidenced by the failure of ABATE of Florida to get any meaningful legislation passed.


In other words. It was a fun motorcycle ride and campout. Kinda like a boy scout jamboree.



I want to let everyone know that we do not put anyone’s name on bills that we do. So many people have died by being struck by driver’s not paying attention that we do not martyr one; we fight for all we have lost. When we go to the Capitol we are fighting for everyone’s rights no matter how pathetic another group may be.

NOTE: James, James, James, which group are you referring to as pathetic this year. Last year it was standing in front of the legislative committees and claiming sport bikers were not "bikers".  But your lie is proved by the actions of one of your goons at "your" "FREEDOM" rally.  I and a friend went to attend the rally and one of your goons insured that we were locked out and denied entrance (although we got in the back way).  Your consistent attempts to violate my rights, even when it is to support your cause is evidence of your lie.  But your goons denying entrance to a lady you do not even know just because she was with me not only compounds  your lie, but brands you as a hypocrite and an oppressor of rights and freedoms. YOU SIR are a CHARLATAN!


To see out people have information and know what they are talking about goes a long way in getting things done. Abate has learned the system and how it works,

NOTE: James, be specific. Who are these vague ghosts you refer to and  what ridiculous statements are they making. You will note in our post about ABATE we are specific and to the point. We have invited you to respond. You don't.  


A primary tactic of Cult leaders is to create unnamed, unknown enemies. Convince the members that the outside is out to get them, close ranks, keep secrets, don't talk unless it reference a vague "they".

Be specific James.  You intimate and allude knowing that your contingent of kool aid drinkers will draw conclusions. But you can not be specific because to do so would prove that you truly are an emperor with no clothes.  Again we invite you to be specific.  Send your evidence and we will  print it. You won't, because you can't.


The lawmakers know us and we have their ear so we will still fight for everyone in the state of Florida no matter what.

NOTE: Yes the Lawmakers know you. And they will listen to you. They listen to any of us that go to talk to them and then proceed to do as they damn well please. This is proven by your lack of accomplishments in the legislature despite having the ear of a few legislators that your members prostitute for, for not a damn thing in return.  Well, let me clarify that. Your members do not get anything, you get a paycheck even when you violate the dictates of the membership. 


We still have bills alive in the legislature and with time running out we think some of them will still get heard.

NOTE: Not anymore. You caved in and still lost.

I want to thank “Mudder” and Sharon for their donation of the bell to ring for our departed members. It is nice to see someone really care about the ceremony and not about them selves. This is the devotion of two real members and Bikers; they are true Americans and Floridians at heart and understand the American way.

NOTE:  Do "Mudder" and Sharon get paid for there services? You get $50,000.00 plus (and we will never know how much that plus really is will we Doc? Have you kept itemized documentation of how you have spent the checks you have received to do with "as the lobbyist see's fit"?  Seem's to this writer you might have come out your own damn pocket for a bell. But then maybe you aren't the American, Floridian, Biker that Mudder and Sharon are.

Of course we won't mention the fact that the purchase of a "Bell" in no way demonstrates an understanding of the "American Way".  It demonstrates the ability to buy a bell.

This summer will be long and hot and everyone must keep on their toes and watch out for people driving irresponsibly. You do not want to become a statistic. With Abate of Florida, Inc.’s Safety program in full force we can say we have had at least some small part in the deaths not increasing in this state. You have all worked hard to help bring these deaths and accidents statistics down and the legislature knows it.
Note: Again James, be specific please, lest we get led down the path of spin and myth.  Please explain to us the full scope of your safety program.  In this county your chapter got rid of the person that went into the schools (not that , that has ever been proven to be effective. Can you show us the research Doc) and when another organization reportedly offered to take it over your chapter agreed, but only if they could get the credit for it. Needless to say your efforts in this county anyway are slim to non existent.   In the Tampa area  One lady, Mother on a Mission has accomplished more through private donations than all the ABATE air fresheners, ball point pens and eyeglass fix it kits could ever achieve.


We need more people to take positions of Assistant Safety Director, people who believe in saving the lives of motorcyclists. The concept is to save lives not have a position for the title,

you must care about the people that is what the program is all about.

779th Engineer Battalion, Tallahassee, FL

The 779th Engineer Battalion will be leaving for Iraq on May 26, 2009. There will be a brief ceremony at the Old Capitol, Tallahassee, at 10 am. We have been invited to attend that event and the escort to the airport that immediately follows. The complete details are not in place yet, but I have been in touch. I expect final plans to be announced May 19. This is a heads up for those of you who can make arrangements to get off or are coming from out of town. We need to let these soldiers know that America supports them as they put themselves in harm’s way. Be looking for staging info.

On Monday, May 11, two riders from Tallahassee Met up with Riders from Thomasville and Cairo Ga. including one from up near Atlanta to escort Mr. James William Mock and his family to Mr. Mocks Final resting place after losing his fight with cancer.
Mr. Mock  was a U.S. Army veteran of the Viet Nam War, a truck driver, and an avid hunter and fisherman.
We wish to thank Bainbridge leo,  County and State LEO for escorting the family to the gravesite.  We wish to thank those Georgians who pulled off to the side of the road and stopped out of respect when they did not have to.

Once again we wish to thank all those from other areas who consistently demonstrate to those of us from Tallahassee that respect, honor and patriotism is still alive in this country, if not in Tallahassee.Add to Technorati Favorites
